1. Introduction

Wercom ("we", "us", "our") is committed to protecting your privacy. This Privacy Policy explains what personal data we collect, why we collect it, how we use it, and what rights you have over it.

This policy applies to all users of the Wercom platform ("Platform"), including buyers, sellers, and visitors. By using the Platform, you agree to the collection and use of your data as described in this Privacy Policy.

This Privacy Policy forms part of Wercom's Terms of Service. If you do not agree with this policy, please do not use the Platform.

2. Who We Are (Data Controller)

For the purposes of the General Data Protection Regulation (GDPR) and other applicable privacy laws, Wercom is the data controller responsible for your personal data.

3. Data We Collect

We collect only the minimum data necessary to operate the Platform. We do not collect more than what is described below.

3.1 Data Obtained via Roblox OAuth Login

Wercom uses Roblox's official OAuth 2.0 authentication system as the sole method of logging into the Platform. We do not operate our own password-based login system. When you sign in with your Roblox account, we receive and store the following data from Roblox:

We do not receive or store your Roblox password, email address, date of birth, or any other personal data beyond what is listed above. The data we receive is limited to what Roblox makes available via OAuth and what is strictly necessary for Platform functionality.

3.2 Platform Activity Data

In addition to the data received from Roblox, we collect and store data generated by your activity on the Platform:

This data is necessary to operate the marketplace, process transactions, maintain order history, and provide the Platform's core functionality.

3.3 Data We Do Not Collect

To be explicit, Wercom does not collect:

  • Your real name
  • Your email address (unless you contact us directly)
  • Your date of birth
  • Your physical address
  • Payment card or banking details
  • Real-money financial information of any kind
  • Roblox account passwords or authentication tokens beyond what is needed for the OAuth session
  • Browsing behaviour, tracking cookies, or analytics beyond what is strictly necessary

4. How We Use Your Data

We use the data we collect for the following purposes:

  • Account identification: Your Roblox username and avatar are used to identify you on the Platform and display your profile.
  • Transaction processing: Purchase and order data is used to confirm transactions, unlock purchased content, and maintain your order history.
  • Seller operations: Product listing data is used to display your assets to buyers and process your monthly payouts.
  • Platform integrity: Activity data may be reviewed in the event of a reported dispute, fraud investigation, or enforcement action under our Terms of Service.
  • Review display: Reviews you submit are displayed publicly on the relevant product listing.

We do not use your data for advertising, profiling, or any purpose beyond the operation of the Platform.

5. Legal Basis for Processing (GDPR)

For users in the European Union, we process your personal data on the following legal bases under Article 6 of the GDPR:

  • Contract performance (Art. 6(1)(b)): Processing your account data, purchase records, and order history is necessary to fulfil our contractual obligations to you as a user of the Platform.
  • Legitimate interests (Art. 6(1)(f)): We may process activity data where necessary to protect the Platform and its users from fraud, abuse, or violations of our Terms of Service.
  • Consent (Art. 6(1)(a)): By choosing to log in via Roblox OAuth and using the Platform, you consent to the collection of the data described in this policy.

6. How We Share Your Data

Wercom does not sell, rent, or trade your personal data to any third party.

Your data may be shared in the following limited circumstances:

  • Roblox Corporation: Your use of the Platform necessarily involves Roblox's OAuth system and Dev Product infrastructure. Data transmitted to or from Roblox is subject to Roblox's own Privacy Policy.
  • Legal obligations: We may disclose your data if required to do so by law, court order, or a request from a competent regulatory or law enforcement authority.
  • Fraud and abuse investigations: In cases of suspected fraud or serious Terms of Service violations, limited data may be shared with Roblox Corporation if necessary to resolve the matter.

Beyond the above, no data is shared with any third party.

7. Data Retention

We retain your data for as long as your account remains active on the Platform, or as long as necessary to fulfil the purposes described in this policy.

Specifically:

  • Account data (username, avatar): Retained for the duration of your account's existence.
  • Purchase and order data: Retained for a minimum of 3 years for record-keeping and dispute resolution purposes, and up to 7 years where required by applicable financial or legal regulations.
  • Product listings: Retained for the duration of the listing's active status, and for a reasonable period after removal for record-keeping.
  • Reviews: Retained until you request their deletion or your account is deleted, subject to our legitimate interests in maintaining accurate product records.

Upon account deletion, we will delete or anonymise your personal data within a reasonable timeframe, except where retention is required by law.

8. Data Security

We take the security of your data seriously and implement appropriate technical and organisational measures to protect it against unauthorised access, loss, or disclosure.

However, no system is entirely secure. We cannot guarantee the absolute security of your data and are not liable for breaches that result from circumstances beyond our reasonable control.

9. Your Rights

Depending on your location, you may have the following rights regarding your personal data:

For all users:

  • Access: You may request a copy of the personal data we hold about you.
  • Correction: You may request that we correct inaccurate or incomplete data.
  • Deletion: You may request that we delete your personal data, subject to our legal obligations and legitimate interests.

For users in the European Union (GDPR):

  • Right to access (Art. 15): Request confirmation of whether we process your data and obtain a copy of it.
  • Right to rectification (Art. 16): Request correction of inaccurate data.
  • Right to erasure (Art. 17): Request deletion of your data ("right to be forgotten"), subject to applicable exceptions.
  • Right to restriction of processing (Art. 18): Request that we limit how we use your data in certain circumstances.
  • Right to data portability (Art. 20): Request your data in a structured, commonly used, machine-readable format.
  • Right to object (Art. 21): Object to processing based on legitimate interests.
  • Right to withdraw consent: Where processing is based on consent, you may withdraw it at any time without affecting the lawfulness of prior processing.
  • Right to lodge a complaint: You have the right to lodge a complaint with your local data protection supervisory authority.

For users in the United States (California — CCPA):

California residents may have additional rights under the California Consumer Privacy Act, including the right to know what data is collected, the right to deletion, and the right to non-discrimination for exercising their rights.

10. Cookies and Tracking

Wercom uses only the minimum cookies and session data necessary to operate the Platform, such as keeping you logged in during a session. We do not use advertising cookies, third-party tracking cookies, or behavioural analytics tools.

11. Children's Privacy

Wercom is not directed at children under the age of 13. We do not knowingly collect personal data from children under 13. If you believe a child under 13 has provided us with personal data, please contact us at wercom@igportals.eu and we will take steps to delete it.

Users between the ages of 13 and 18 should use the Platform only with the consent of a parent or legal guardian.

12. Third-Party Links and Services

The Platform may contain links to third-party websites, including Roblox. This Privacy Policy does not apply to those third-party services. We encourage you to review the privacy policies of any third-party services you use in connection with the Platform, particularly Roblox's Privacy Policy at https://en.help.roblox.com/hc/en-us/articles/115004630823.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will update the "Last Updated" date at the top of this page. Continued use of the Platform following any update constitutes your acceptance of the revised policy.
