1. Introduction and Acceptance of Terms

Welcome to Wercom ("the Platform", "we", "us", "our"), a digital marketplace operated for the purpose of buying and selling Roblox game development assets. By accessing or using Wercom in any capacity — whether as a visitor, registered user, buyer, or approved seller — you ("the User", "you", "your") agree to be legally bound by these Terms of Service ("Terms").

If you do not agree to these Terms in their entirety, you must immediately cease all use of the Platform. These Terms constitute a legally binding agreement between you and Wercom.

Wercom reserves the right to update or modify these Terms at any time. Continued use of the Platform following any modification constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

2. Platform Description

Wercom is an online marketplace designed exclusively for the sale and purchase of Roblox game development assets, including but not limited to .rbxm files, scripts, models, and other digital content compatible with the Roblox development environment ("Assets").

How Purchases Work

All purchases on Wercom are processed exclusively through the Roblox platform via Developer Products ("Dev Products"). The purchase flow is as follows:

A buyer browses listings and adds items to their cart.
The buyer proceeds to checkout, which directs them to a designated Roblox game operated by Wercom.
Within that Roblox game, the buyer purchases the Dev Product associated with the specific item they wish to acquire.
Each product listed on Wercom has a unique, individually associated Dev Product on Roblox.
Upon successful purchase of the Dev Product, the content associated with that product (e.g., .rbxm files and other attachments) is unlocked and made available to the buyer.

All Dev Products are registered under the official Wercom Roblox group. By using the Platform, you acknowledge and accept this purchasing mechanism in full.

3. Eligibility

By using Wercom, you represent and warrant that:

You are at least 13 years of age, or the minimum age required to use Roblox in your jurisdiction, whichever is greater.
If you are under 18, you have obtained verifiable parental or guardian consent to use the Platform and to make purchases via Roblox.
You have the legal capacity to enter into a binding agreement.
Your use of the Platform does not violate any applicable laws or regulations in your jurisdiction.
You will comply with all applicable Roblox Terms of Service and Community Standards at all times.

Wercom reserves the right to deny access to or terminate the account of any user who does not meet these eligibility requirements.

4. User Accounts

To access certain features of the Platform, you may be required to register for an account. You agree to:

Provide accurate, current, and complete information during registration.
Maintain and promptly update your account information to keep it accurate.
Maintain the confidentiality of your login credentials.
Accept full responsibility for all activity that occurs under your account.
Notify Wercom immediately at wercom@igportals.eu if you suspect any unauthorized access to your account.

Wercom is not liable for any loss or damage arising from your failure to protect your account credentials.

5. Seller Registration and Approval

Application Process

Selling on Wercom is not open to the general public by default. To become an approved seller, all prospective sellers must:

Complete the official Wercom seller application form.
Submit accurate and truthful information, including details about themselves and the assets they intend to sell.
Await manual review and approval by Wercom administrators.

Wercom reserves the sole and absolute discretion to approve or reject any seller application, for any reason or no reason at all, without obligation to disclose the rationale.

Seller Obligations

Once approved, sellers agree to:

List only assets they have the full legal right to sell (original work or properly licensed content).
Accurately describe all products, including their contents, compatibility, and any limitations.
Not engage in deceptive, fraudulent, or misleading listing practices.
Maintain the quality and integrity of their listed assets.
Comply with all applicable Roblox Terms of Service relating to asset creation and distribution.
Not list assets that infringe upon third-party intellectual property rights.

Wercom reserves the right to remove listings, suspend, or permanently ban sellers who violate these obligations, at its sole discretion and without prior notice.

6. Pricing and Payments

Currency

All transactions on Wercom are conducted in Robux, the virtual currency of the Roblox platform. Wercom does not process any real-money (fiat currency) payments directly.

Dev Product Pricing

Product prices are displayed on Wercom listings in Robux. The final purchase is made via the Roblox Dev Product associated with each listing. Wercom cannot guarantee that Roblox's platform fees or exchange rates will remain constant and is not liable for any changes made by Roblox to their fee structures.

Wercom Commission

Wercom charges sellers a platform commission of 10% (ten percent) of the gross Robux value of each sale, in addition to any fees charged by Roblox itself (including Roblox's standard marketplace/Dev Product fee). This commission is deducted prior to seller payouts.

Seller Payouts

Payouts to sellers are processed manually on the last day of each calendar month.
The payout amount reflects the seller's total earnings during that calendar month, minus Wercom's 10% commission and Roblox's applicable platform fees.
Payouts are distributed in Robux via the Wercom Roblox group.
Wercom is not responsible for delays caused by Roblox platform outages, group fund limitations, or other circumstances outside Wercom's direct control.
Sellers are solely responsible for any tax obligations arising from their earnings on the Platform. Wercom does not provide tax advice.

7. Refund and Cancellation Policy

General Non-Refundability

All purchases made on Wercom are final and non-refundable. By completing a purchase via the associated Roblox Dev Product, you acknowledge and agree that:

Upon completing a purchase, the digital content (e.g., .rbxm files and other attachments) associated with that product is immediately unlocked and accessible to you.
Because digital content is delivered and accessible immediately upon purchase, no refund can be issued, as the product has already been consumed.
Roblox's own platform fee is deducted at the point of purchase and cannot be recovered by Wercom, making full refunds technically impossible even in exceptional circumstances.

This policy applies regardless of whether you have actually downloaded or used the content after it was unlocked.

Exceptional Circumstances — Fraudulent Transactions

Wercom may, entirely at its own discretion and on a strictly case-by-case basis, consider issuing a partial compensatory credit in the event of verified fraudulent activity. Should such a case be deemed valid:

The compensatory amount will not exceed the Robux value of the purchase minus Roblox's applicable platform fee.
Wercom makes no guarantee that any such compensation will be provided and reserves the right to decline any refund request.
To report suspected fraudulent activity, contact Wercom at wercom@igportals.eu with all relevant information.

How to Request a Review

If you believe you have a valid claim relating to a fraudulent transaction, you must:

Contact Wercom at wercom@igportals.eu within 14 days of the transaction.
Provide your Roblox username, the product in question, the date and approximate time of purchase, and a detailed description of the issue.
Cooperate fully with any investigation Wercom may undertake.

Wercom will acknowledge receipt of your request but makes no commitment regarding timelines or outcomes.

8. Prohibited Conduct

Users of the Platform — whether buyers, sellers, or visitors — are strictly prohibited from:

Submitting false, misleading, or fraudulent information in any form, including seller applications and product listings.
Listing, selling, or distributing assets that infringe upon the intellectual property rights of Roblox, third-party developers, or any other rights holder.
Attempting to reverse-engineer, decompile, or otherwise exploit the Platform's systems or Roblox Dev Products.
Using the Platform for any illegal purpose under applicable law, including but not limited to fraud, money laundering, or copyright infringement.
Harassing, threatening, or abusing other users of the Platform.
Attempting to manipulate the payout system, circumvent Wercom's commission, or otherwise exploit the Platform's financial mechanisms.
Creating multiple accounts to evade a suspension or ban.
Posting or distributing malicious code, viruses, or harmful scripts disguised as assets.
Engaging in any form of "charge-back fraud" or attempting to reverse Roblox transactions through Roblox's own support after receiving the purchased content.

Violation of any of these prohibitions may result in immediate account termination and, where applicable, reporting to relevant authorities.

9. Intellectual Property

Seller Representations

By listing an asset on Wercom, sellers represent and warrant that:

They are the original creator of the asset, or hold all necessary rights and licenses to sell it.
The asset does not infringe upon the intellectual property rights of any third party, including Roblox Corporation.
They grant Wercom a non-exclusive, royalty-free license to display, reproduce, and promote the asset listing (including thumbnails and descriptions) for the purpose of operating the Platform.

Buyer Rights

Upon purchasing an asset, buyers receive a limited, non-exclusive, non-transferable license to use the purchased asset for their own Roblox game development projects, subject to any additional license terms specified by the seller in their listing. Buyers may not:

Resell, redistribute, or re-list purchased assets on Wercom or any other platform without the seller's explicit written permission.
Claim authorship or ownership of purchased assets.
Use purchased assets in ways that violate Roblox's Terms of Service.

Wercom's Intellectual Property

All original content on the Wercom Platform — including its design, branding, logos, interface elements, and written content — is the property of Wercom and its operators. Unauthorized reproduction or use is prohibited.

10. Reporting and Enforcement

Reporting Violations

Wercom takes reports of fraudulent, deceptive, or otherwise violating behavior seriously. Users may report concerns via the Platform's contact form or by emailing wercom@igportals.eu.

When submitting a report, please include:

Your Roblox username.
The username of the seller or buyer involved.
The product listing in question.
A clear description of the suspected violation.
Any supporting evidence (screenshots, links, etc.).

Enforcement Actions

Wercom reserves the right to take any of the following enforcement actions, at its sole discretion:

Issue a warning to the offending user.
Remove offending listings from the Platform.
Suspend a user's account temporarily or permanently.
Withhold pending payouts pending investigation.
Permanently ban a seller from the Platform.
Report the matter to Roblox Corporation or relevant law enforcement authorities.

Wercom is not obligated to inform users of the specific outcome of any investigation.

11. Disclaimers and Limitation of Liability

Platform Provided "As Is"

The Wercom Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. Wercom does not warrant that:

The Platform will be uninterrupted, error-free, or secure.
Any defects or errors will be corrected.
The Platform or its servers are free of viruses or harmful components.

No Warranty on Assets

Wercom does not inspect, verify, or guarantee the quality, accuracy, functionality, safety, or legality of any asset listed by sellers. Buyers purchase assets at their own risk. Any dispute regarding asset quality must be resolved directly between the buyer and the seller.

Limitation of Liability

To the maximum extent permitted by applicable law, Wercom and its operators, employees, affiliates, and agents shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages.
Loss of profits, revenue, data, goodwill, or other intangible losses.
Damages arising from your access to or use of (or inability to access or use) the Platform.
Damages arising from transactions conducted through Roblox, including Roblox platform outages, errors, or policy changes.
Any unauthorized access to or alteration of your data.

In any event, Wercom's total liability to you for any claim shall not exceed the Robux equivalent of the specific transaction giving rise to the claim, minus applicable fees.

Roblox Dependency

Wercom's purchasing and delivery mechanism is entirely dependent on the Roblox platform. Wercom is not affiliated with, endorsed by, or in partnership with Roblox Corporation. Wercom is not responsible for:

Changes to Roblox's Terms of Service, Developer Product policies, or fee structures.
Roblox platform outages, bugs, or service disruptions.
Actions taken by Roblox Corporation against user accounts.

12. Compliance with Roblox Terms of Service

All users of Wercom must comply with Roblox's Terms of Service and Community Standards at all times. Wercom operates within the Roblox ecosystem and does not condone any activity that would violate Roblox's policies. In the event of any conflict between Roblox's Terms of Service and Wercom's Terms, Roblox's Terms shall take precedence in matters directly relating to the Roblox platform.

13. Privacy and Data

Wercom collects and processes limited personal data for the purpose of operating the Platform, including account information, contact details, and transaction data. By using the Platform, you consent to this processing.

Wercom does not sell personal data to third parties. Data may be shared with Roblox in the normal course of platform operations.

Users in the European Union have rights under the General Data Protection Regulation (GDPR), including the right to access, rectify, and request deletion of their personal data. To exercise these rights, contact wercom@igportals.eu.

Wercom's full Privacy Policy, which forms part of these Terms, is available on the Platform.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law. Given Wercom's operation across international jurisdictions:

For users located in the European Union, these Terms shall be interpreted in a manner consistent with applicable EU consumer protection law, including but not limited to the EU Consumer Rights Directive and GDPR.
For users located in the United States, these Terms shall be governed by applicable federal and state law.

Any disputes arising from or relating to these Terms or your use of the Platform that cannot be resolved informally shall be subject to binding arbitration or the jurisdiction of competent courts as applicable.

Nothing in these Terms limits any rights you may have under mandatory consumer protection laws in your country of residence that cannot be contractually waived.

15. Indemnification

You agree to indemnify, defend, and hold harmless Wercom and its operators, employees, affiliates, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

Your use of or access to the Platform.
Your violation of these Terms.
Your violation of any third-party rights, including intellectual property rights.
Any content, assets, or listings you submit to the Platform.
Any fraudulent or illegal activity you engage in through the Platform.

16. Termination

Wercom reserves the right to suspend or terminate your access to the Platform at any time, for any reason, including but not limited to violation of these Terms, without prior notice and without liability.

Upon termination:

Your right to access and use the Platform ceases immediately.
Any pending seller payouts may be withheld pending investigation of the reason for termination.
Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, and limitations of liability.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the enforceability of the remaining provisions.

18. Entire Agreement

These Terms, together with Wercom's Privacy Policy and any other policies published on the Platform, constitute the entire agreement between you and Wercom regarding your use of the Platform and supersede all prior agreements or understandings, whether written or oral.
